1) Purpose of the Services

The Services exist to help businesses and individuals request information and initiate conversations regarding advertising opportunities and related media services. Submitting an inquiry does not guarantee acceptance, availability, pricing, placement, or publication.

2) Eligibility

6) Third-party services

We may use third-party platforms to provide forms, analytics, CRM, and communications. Your use may be subject to those providers’ terms. We are not responsible for third-party services outside our control.

7) Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

8) Limitation of liability

To the maximum extent permitted by law, FitWell Life will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services.

If liability cannot be excluded, FitWell Life’s total liability for all claims relating to the Services will not exceed $100.

9) Indemnification

You agree to indemnify and hold harmless FitWell Life from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your submissions, or your violation of these Terms.

10) Termination

We may suspend or terminate access to the Services at any time, with or without notice, if we believe you violated these Terms or if necessary to protect the Services or others.

11) Governing law and venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Missouri, unless otherwise required by law.

12) Changes to these Terms

We may update these Terms periodically. The Effective Date above indicates the latest version. Continued use after changes means you accept the updated Terms.

13) Entire agreement

These Terms, together with the Privacy Policy, form the entire agreement between you and FitWell Life regarding the Services.
